Club rules

Rules and Policies

These Rules and Policies are intended to be a guide for the use of the facility of Bella Vista Music Club.  They are not intended to deal with every conceivable issue that may be presented for governance. These Rules and Polices are established by the Club to protect the Club Facility and to promote the health, safety, welfare and enjoyment of the Members, their families and guests and all persons using the Club Facility.  The Club is committed to providing all Members, their families and guests with an enjoyable club experience. To uphold these standards Members are expected to act in a manner consistent with good taste. The Club may amend, modify or supplement these Rules and Policies from time to time as it determines appropriate in its sole discretion. 

General Club Rules

  1. Members, their family members (i.e. Immediate Family Members and Extended Family Members) and their guests shall abide by all Rules and Policies of the Club as they may be amended, modified or supplemented from time to time. Reference herein to “Member”  shall include Immediate Family Members of the Members unless otherwise indicated or the context indicates to the contrary. 

  2. The Club Facility shall be open on the days and during the hours established from time to time by the Club. Areas of the Club Facility may also be closed from time to time for scheduled maintenance and repairs.

  3. Alcoholic beverages will not be served or sold, nor permitted to be consumed at the Club during hours or at locations prohibited by law. No alcoholic beverages will be sold or served to any person not permitted to purchase the same under the laws of the State of Texas, or any applicable ordinances or regulations. All alcoholic beverages consumed or possessed at the Club must be sold and purchased from licensed and qualified vendors of the Club. The Club reserves the right, in its sole discretion, to refuse service to a Member, family member or guest when that Member, family member or guest appears to be intoxicated. 

  4. Outside catering is not permitted.  All food and beverages consumed at the Club Facility must be furnished by the Club unless otherwise permitted by the Club Manager. 

  5. Commercial advertisements shall not be posted or circulated on Club premises nor shall solicitations of any kind be made thereon upon the Club’s stationery without the prior approval of the Club. 

  6. Other than as permitted by the Club, no petition shall be originated, solicited, circulated or posted at any of the Club Facility. 

  7. Members shall not use the roster or list of Members of the Club for solicitation or commercial purposes. Members shall not distribute the roster or list of Members.

  8. It is contrary to the Club’s policy to have the Facility used for functions which are in any way related to past, present or future fundraising efforts for the benefit of a political cause, except as specifically permitted by the Club. The Club Facility shall not be used in connection with organized religious services unless otherwise determined by the Club from time to time.

  9. Members should not request special personal services from employees of the Club who are on duty or the personal use of furnishings or equipment at the Club which are ordinarily available for Club use. 

  10. Dogs or other pets (with the exception of seeing eye dogs) are not permitted at the Club Facility, except under specific circumstances or with the permission of the Club Manager. When dogs are permitted on the grounds, they must be on a leash.  Members are responsible for damage or injury caused by an animal owned by the Member or under the members’ control.

  11. All complaints, criticisms or suggestions of any kind relating to any of the operations of the Club or its employees must be in writing and signed and addressed to the Club Manager.

  12. Members and their guests may not abuse any of the Club employees, verbally or otherwise.  All employees are under the supervision of the Club Manager and no Member or guest shall reprimand or discipline any employee, nor shall a Member request an employee to leave the Club Facility for any purpose whatsoever.  Any employee not rendering courteous and prompt service should be reported to the Club Manager immediately.

  13. No unlicensed vehicles are permitted at the Club Facility.

  14. Smoking is not permitted at the Club Facility.

  15. Absolutely no fireworks are permitted anywhere at the Club Facility or an adjacent area unless part of a fireworks exhibit organized and conducted by the Club.

  16. Firearms and all other weapons of any kind are not permitted at the Club Facility at any time. 

  17. No Member, family member, visitor or guest is allowed in designated service, restricted or private areas.

  18. Use of the Club Facility may be restricted or reserved from time to time by the Club. 

  19. Violation of any of these rules or conduct in a manner prejudicial to the best interests of the Club will subject the person in violation to disciplinary action in accordance with these rules and policies. 

  20. The personnel of the Club have full authority to enforce these rules and policies, and any infractions will be reported to the Club Manager. 

  21. In no event shall the Club discriminate against any individual because of the individual’s race, color, religion, sex, national origin, age, handicap or marital status.

Mailing Addresses

Each Member shall be responsible for providing the Club with their current mailing address, email address and contact phone number.  The Club must be notified of any change of address or change of email address.  Failure to provide notice of any change of address shall constitute a waiver of the rights to receive Club notices, bulletins and any other communications, and a violation these rules.

Discipline

  1. Members are responsible for their own conduct and for the conduct of their family members and guests. Any Member whose conduct or whose family member’s or guest’s conduct shall be deemed by the Club to likely endanger the welfare, safety, harmony or good reputation of the Club or its members or is otherwise improper, may be reprimanded, suspended or expelled from the Club and have all privileges associated with his or her member suspended or terminated by the Club. The Club shall be the sole judge of what constitutes improper conduct, but improper conduct will include, without limitation: (i) failure to meet eligibility for membership (ii) submitting false information in the Membership Agreement, (iii) failing to pay any amount owed to the Club in a proper and timely manner, (iv) failing to abide by the rules and policies as set forth herein and as established by the Club from time to time, (v) abusing Club personnel or employees, (vi) damaging Club Facility or surrounding property, (vii) reckless driving in or around the Club Facility, (viii) acting in a manner incompatible with the standard of conduct of the existing membership or which would likely injure the reputation of the Club. 

  2. Any Member accused of improper conduct shall be notified of the Club’s proposed disciplinary action and shall be given an opportunity to be heard by the Club to show cause why he or she should not be disciplined. If such Member desires to be heard, the Club shall set a time and date (not less than 10 days thereafter) for a hearing. Notwithstanding the foregoing, the Club can immediately suspend a Member in its discretion. Absent suspension, while such a complaint is being considered by the Club the Member shall enjoy the privileges of membership.  The Club may, after notice, expel a Member for failure to pay in a proper and timely manner dues, fees or any other amounts owed to the Club.

Resignation of Membership

A Member may resign membership in the Club by delivering written notice of resignation to the Club.

Loss or Destruction of Property or Instance of Personal Injury
  1. Each Member as a condition of membership, and each guest as a condition of invitation to the Club Facility, assumes sole responsibility for his or her property. The Club shall not be responsible for any loss or damage to any private property used or stored at the Club Facility.

  2. Any such personal property which may have been left in or at the Club Facility for six months or more without payment of storage thereon, may be sold by the Club, with or without notice, at a public or private sale, or may be otherwise disposed of, and the proceeds, if any, shall belong to the Club.

  3. No person shall remove from the Club or the property premises any food, beverage, merchandise, property or furniture belonging to the Club or Owner without proper written authorization. Every Member shall be liable for any property damage and/or personal injury at the Club or property, or at any activity or function operated, organized, arranged or sponsored by the Club, caused by the Member, and family member or guest. 

  4. Any Member, family member, guest or other person who, in any manner, makes use of any apparatus, appliance, facility, privilege or service whatsoever owned, lease or operated by the Club, or who engages in any contest, game function, exercise, competition or other activity operated, organized, arranged or sponsored by the Club, either on or off the Club or Owner’s premises, shall do so at his or her own risk. The Member, his or her family members and guest shall hold the Owner, the Club, their respective affiliates, their respective successors, assigns, and their respective directors, officers, employees, shareholders, partners, members of any limited liability company, representative and agents (“Indemnified Parties”) harmless from any and all loss, cost, claim, injury, damage or liability sustained or incurred by him or her, resulting therefrom and from any act or omission, whether due to negligence or otherwise, of any Indemnified Party. Any Member shall have, owe and perform the same obligation to the Indemnified Parties hereunder with respect to any such loss, cost, claim, injury, damage or liability sustained or incurred by any family member or guest.

  5. Should any party bound by these Rules and Policies bring suit against any of the Indemnified Parties in connection with any event operated, organized, arranged or sponsored by the Club or on any other claim or matter in connection with membership in the Club, and fail to obtain judgment therein again any one or more of them, said party shall be liable to the prevailing Indemnified Parties for all costs and expenses incurred by them in the defense of such suit, including court costs and attorneys' fees and expenses through all appellate proceedings.

Reservations
  1. Reservations are required for most activities and events at the Facility and shall be accepted on a first-come, first-served basis in most cases. 

  2. Category or Level of Membership may determine how invitations to certain events will be prioritized. 

Children
  1. Children under 12 years of age are not allowed at the Club Facility unless accompanied and supervised by an adult, except as otherwise permitted by the Club.

  2. Members are responsible for the conduct and safety of their children when at the Club Facility.

Guest Privileges

Guest privileges may be extended to guest of Members subject to applicable guest fees, charges and Rules and Policies established by the Club from time to time. Although it is the intention of the Club to accommodate guests without inconvenience to Members, the Club reserves the right to limit the number of guest that accompany a Member on any given day or event.  Guest privileges may be denied, withdrawn or revoked at any time for reasons considered sufficient by the Club in its sole and absolute discretion.  The Club reserves the right to require identification by each guest.
